First, know this: this decision is not the last word. You can challenge it. You have time, but not much.

Three things to do now

1. Check the date.

If the decision was handed to you or formally notified to you, you have 7 days from that date to file a case at the administrative court. This deadline is not extended. Keep the notice and the date written on it, and take a photo of it.

2. Gather your documents.

  1. The decision paper you were given
  2. Passport or ID
  3. Residence permit or application papers
  4. Anything showing your ties to Turkey: marriage certificate, your child's documents, a letter from work or school, a rental contract, a medical report

3. Do not sign anything you do not understand.

Do not sign papers such as a "voluntary return" form before you understand the consequences. A signature can affect your right to go to court.

What happens when a case is filed?

If a case is filed within the deadline, you are not removed from the country until the court decides. Courts review files in turn, and because of heavy workloads this often takes months. That time is yours to organise your situation, complete your documents and plan ahead. The result is never known in advance.

If you are in a removal center

Being held there is a separate decision from the deportation decision, and it is handled through separate routes:

  1. Against the deportation decision: a case is filed
  2. Against being held: a court decision is obtained for your release
  3. Your situation is reported in writing to the migration authority

Each route has its own purpose and deadline, and one does not replace another. Having your identity, address and passport documents complete matters when it is assessed whether you need to be held. If nothing prevents it, going home while the case continues may also come up.

Every case is different

The reason for the decision (overstay, public order, entry ban or another reason) and your situation decide which route is open. Showing your decision and its date to a lawyer quickly clarifies which route applies to you.
